BOLR Updated: Suggested Language for Potential Notice
Dear BOLR Member
We have received the suggested notice of layoff to be used by BOLR members in informing employees of a layoff, per our legal team:
“We regret to inform you that we will have to place you on temporary furlough beginning at the end of your scheduled shift on ________, 2020. The reduced need for our services in the building to which you are assigned is as a result of office closures caused by the COVID-19 outbreak. We have only recently been informed by building management that these cutbacks are necessary and are to take place immediately. We expect that we will be able to end your furlough as soon as business activity returns to normal.”
The key parts of this notice are referring to the action as a “temporary furlough,” (emphasizing temporary) rather than a layoff, that this action is COVID-19 related, and is at the direction of building management.
The statement regarding the action being at the direction of building management should be included only if, and to the extent, it is factually accurate.
